These Terms of Use (TOU) govern access to and use of the online platform Twister Spread, provided by Grezy Software. By accessing this platform, the user unreservedly accepts these TOU. Twister Spread is a SaaS platform dedicated to tracking and analyzing results in the field of mogul skiing. Grezy Software is a company registered under number 933476632, with its head office located at 89 rue Mallifaud, 38100 Grenoble.
1. Access and use of Twister Spread.
Access to Twister Spread is reserved for users who have accepted these TOU Any person using the platform must have a user account. Registration requires the provision of accurate and complete personal information.
1.1 Registration Conditions
Upon registration, the user agrees to provide accurate information. A user must be 16 years of age or older to register, or have the consent of a legal representative.
1.2 Technical Requirements
The Twister Spread platform can be used via an up-to-date web browser (Google Chrome, Mozilla Firefox, Safari, etc.). The user is responsible for configuring their device (computer, smartphone, etc.) to access the services. Automated methods or those not using the graphical interface (via the web browser) are not authorized.
2. Subscription and Payment
Certain services of Twister Spread are accessible by subscription. The terms and rates of the subscriptions are available on the dedicated page of the platform.
2.1 Payment Methods
Subscription payments are made via the provider Stripe, which securely processes users' payment information. No confidential data regarding payment methods is provided to Grezy Software. The subscription is not billed on a recurring basis, unless otherwise stated in the specific terms of the offer.
Grezy Software reserves the right to modify the recurrence of a subscription for any new subscription taken by the user.
3. Intellectual Property
The content of the Twister Spread site, including but not limited to texts, graphics, logos, images, videos, data, databases, as well as all elements constituting the platform, are the exclusive property of Grezy Software and its partners, and are protected by French and international laws relating to intellectual property.
Any reproduction, representation, modification, adaptation, publication, transmission, or partial or total exploitation of the content of the Twister Spread platform without the prior written authorization of Grezy Software is strictly prohibited. Such unauthorized reproduction could constitute copyright infringement, punishable by the Intellectual Property Code, and result in legal proceedings.
4. Security
The user agrees to maintain the security of their user account by protecting their login credentials (username and password). Any fraudulent use of the account will be the responsibility of the user. The user has a moral obligation to use a password that they have never used elsewhere to ensure the security of their own account.
Grezy Software implements appropriate security measures to protect personal data and ensure the security of the site.
5. Limitation of Liability
Grezy Software strives to ensure uninterrupted access to the platform but cannot be held responsible for any service interruptions due to platform updates, technical issues, human errors, or events beyond its control.
Grezy Software is not responsible for errors in the analysis of sports results, which may be due to incorrect information provided by users or human errors.
6. Personal Data
The User acknowledges having read and accepted the privacy policy of Grezy Software for the Twister Spread platform, specifying the conditions under which their personal data is processed and the rights granted to them by the applicable legislation.
7. Modification of the Terms of Use
Grezy Software reserves the right to modify these TOU at any time. Users will be notified of any modifications via a notification on the platform or by email. Users must accept the new TOU to continue using the services.
8. Applicable Law and Jurisdiction
These TOU are governed by French law, and the competent courts will be those of Grenoble, France.
In the event of a dispute or claim related to the use of Twister Spread services, the user agrees to release Grezy Software from any liability if the user is unable to prove, with sufficient evidence, that Twister Spread has directly caused a significant financial loss. Grezy Software cannot be held responsible for loss of revenue or any other form of financial harm, unless such loss is directly attributable to a proven failure or negligence on our part, and to the extent that it can be proven beyond doubt.
Furthermore, the user agrees to contact Grezy Software directly to attempt to resolve any claim or dispute amicably by sending an email to the following address: contact@grezy.org. The user may not take any legal action against Grezy Software without first attempting to resolve the dispute through this amicable procedure.
All disputes arising from the purchase and sale transactions concluded under these terms and conditions, concerning their validity, interpretation, execution, termination, consequences, and follow-up, and which could not be resolved between the seller and the client, will be submitted to the competent courts under common law.
